New Essence Health Terms of Service
Effective date: October 11, 2026
1. Acceptance of these terms
These Terms of Service (“Terms”) govern your use of newessencehealth.com (the “Website”), which is operated by New Essence Health, P.C. (“New Essence Health,” “we,” “us” or “our”), a direct primary care practice at 3143 E Shadowlawn Ave NE, Atlanta, GA 30305.
By using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.
The Website is intended for adults aged 18 and older. If you are under 18, please do not use the Website or submit information through it.
2. Information only, not medical advice
The content on the Website, including blog posts, articles and FAQs, is for general educational purposes. It is not medical advice, diagnosis or treatment, and it is not a substitute for care from a licensed clinician who knows your history.
- No doctor-patient relationship. Visiting the Website, reading its content, or sending us a message, form or email does not create a doctor-patient relationship. That relationship begins only after you complete enrollment and we have agreed in writing to provide care.
- Do not rely on the Website for urgent needs. If you think you have a medical emergency, call 911 or go to the nearest emergency department. Do not use the Website, email or text to ask for urgent help.
- Please do not send sensitive health details through website forms, email or text. See our Privacy Policy for how to contact us safely.
- Information may change. Medical knowledge and guidelines change, and content may be out of date. Talk to your own clinician before making health decisions.
3. Membership, telemedicine and services
The Website describes our direct primary care membership and our in-person and telemedicine services. Descriptions on the Website are general and may change.
- A separate agreement controls. Membership, fees, services and cancellation are governed by the written Membership Agreement and consent forms you sign when you enroll. If they differ from the Website, the signed documents control.
- Not insurance. Direct primary care membership is not health insurance and does not replace it. We encourage you to keep health insurance for emergencies, hospital care, specialist care and other services a membership does not cover.
- Services are not guaranteed. We do not guarantee any particular outcome, test result, treatment, appointment time or availability. Some conditions or requests may not be suitable for telemedicine or for our practice, and we may refer you elsewhere.
- Telemedicine location. Telemedicine visits are available to patients who are physically located in Georgia at the time of the visit. Care outside Georgia may be limited.
- Eligibility. Our services are for adults aged 18 to 64. We may decline to enroll someone, or refer them elsewhere, when we are not able to meet their needs safely. Ending care after enrollment follows your Membership Agreement and applicable law, including reasonable notice where required.
4. Appointments and communications
When you book a free discovery call, request an appointment or contact us through the Website, you agree to give us accurate information. Discovery calls are for questions about the practice and are not medical visits.
By giving us your phone number or email address, you agree that we may contact you by phone, text message or email about your inquiry, appointments and practice updates. Consent to texts or marketing messages is not required to enroll or to receive care. Message and data rates may apply. You can opt out of marketing messages at any time by replying STOP to a text or clicking “unsubscribe” in an email. We will still send messages about appointments and your account.
Email and text are not secure ways to share health information. Please use them only for scheduling and general questions.
5. Acceptable use
You agree to use the Website only for lawful purposes. You agree not to:
- submit false, misleading or someone else’s personal information;
- upload or send malware, or try to disrupt, probe or gain unauthorized access to the Website or its servers;
- use bots, scrapers or other automated tools to collect content or data from the Website without our written permission;
- submit spam, advertising or harassing, unlawful or abusive messages through our forms;
- impersonate any person or organization, or misrepresent your connection to us; or
- use the Website in a way that violates any law or the rights of others.
If you send us a message or other content through the Website, you give us permission to use it to respond to you and to operate the practice, as described in our Privacy Policy. We may block access to the Website if we believe these rules have been broken.
6. Intellectual property, third-party links and Google services
Our content. The Website’s text, articles, graphics, logos, name and design belong to New Essence Health or its licensors and are protected by copyright and trademark law. You may view the Website and share links to it. You may print or copy a small amount of content for personal, non-commercial use if you keep our copyright notice. You may not copy, republish, sell or create derivative works from the Website without our written permission.
Third-party links and services. The Website may link to other sites or use outside services, such as Google Analytics, Google Maps, Google reCAPTCHA, Google Ads, scheduling tools and social media platforms. We do not control these services and are not responsible for their content, policies or practices. Your use of them is governed by their own terms and privacy policies, including Google’s Terms of Service and Google’s Privacy Policy.
Advertising. We may advertise our services online. Advertising is not medical advice, and an ad is not a promise of any result.
7. Disclaimers, limitation of liability and indemnity
Website provided “as is.” TO THE FULLEST EXTENT THE LAW ALLOWS, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not promise that the Website will be uninterrupted, error-free or free of harmful components, or that its content is complete or current.
Limitation of liability. To the fullest extent the law allows, New Essence Health, Dr. Badrun and our staff and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Website or reliance on its content. Our total liability to you for all claims relating to the Website will not exceed $100. Nothing in these Terms limits liability that cannot be limited by law, including liability for professional services you receive as a patient, which is governed by the laws of Georgia and your signed agreements. Nothing in these Terms waives any right you have under HIPAA or other applicable law.
Indemnity. You agree to cover reasonable losses we incur from your misuse of the Website or your violation of these Terms, to the extent the law allows.
8. Governing law, changes and contact
Governing law. These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Any dispute about the Website or these Terms will be brought in the state or federal courts located in Fulton County, Georgia, and you agree to their jurisdiction, except where the law requires otherwise. Before starting a legal claim about the Website, please contact us and give us 30 days to try to resolve it informally.
Changes. We may update the Website and these Terms from time to time. The “Effective date” above shows the latest version. By continuing to use the Website after changes are posted, you accept the updated Terms.
Termination. We may suspend or end your access to the Website at any time if you violate these Terms or if we need to protect the Website or others.
Severability. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a part is not a waiver of it. These Terms, together with the Privacy Policy and any agreement you sign with us, are the entire agreement about your use of the Website. You may not transfer your rights under these Terms. We may transfer ours as part of a sale or reorganization of the practice.
